Is mold or mold damage considered a construction defect?

Mold taken on its own is not considered a construction defect. The presence of mold is the resulting damage from moisture intrusion allowed by a construction defect affecting a building. Some examples of these types of construction defects that allow moisture intrusion and promote mold growth are roof leaks, and water intrusion through defective flashings and stucco, window leaks, and improperly waterproofed concrete in slabs and foundations. Mold is a significant concern and the cause of great concern. Certain types of mold can put one ’s health at risk, and may cause one’s immune response to deteriorate. The symptoms of mold exposure include cold and flu like symptoms, backaches, dizziness, fatigue, fever, headaches, nausea, respiratory congestion, respiratory disease, sore throat, vomiting, watery eyes, and an increase in allergies.
