E-Verify will lead to other immigration reforms

This week, at a press conference, Homeland Security Secretary Janet Napolitano suggested that E-Verify should be only the beginning of a series of immigration reforms in the U.S.

“If you do just E-Verify, you’re not doing enough … E-Verify by itself doesn’t solve all the problems we have with existing laws,” said Napolitano.

In addition to E-Verify, Napolitano said she believes that the DREAM Act needs to be passed and more H1-B and H2-B visas should be made available to non-citizens.

Federal judge drops deportation case for same-sex couple

On Monday, a federal judge in San Francisco dropped a deportation case that could potentially separate a same-sex couple living in Cathedral City and married in Connecticut.  This is the second time Immigration and Customs Enforcement has decided to terminate a deportation case involving a same-sex couple.

The man involved in the case moved to the United States from Venezuela and his visa expired in 2009.  The Defense of Marriage Act prevents married, same-sex couples from receiving marriage visas.  As a result, the couple worried that if they could not renew the man’s visa, he could be deported and their marriage would suffer.

Sources say that the judge’s ruling aligns with President Obama’s refusal to defend the DOMA because it is unconstitutional.  The couple says they are excited about the ruling, but hope that someday binational, same-sex couples will be able to sponsor citizenship with marriage visas.

Spanish-language E-Verify Self Check now available in CA

The E-Verify Self Check program is now being offered in Spanish in 16 additional states. Originally, the program, which launched in March, was only offered in Spanish in five states and the District of Columbia.

The added states include California, Texas, Louisiana, Maryland, Nebraska, Maine, Massachusetts, New York, South Carolina, Ohio, Utah, Washington, Minnesota, New Jersey, Nevada, and Missouri.

Employers use E-Verity to validate workers’ Form 1-9s and eligibility to work in the United States. The Self Check program allows workers to check their employment status online through the USCIS and Social Security Administration.

USCIS Director Alejandro Mayorkas said of the expansion, “By offering Self Check to Spanish speakers and making services more widely available, USCIS makes good on a promise to streamline and protect the integrity of the E-Verify process for employees and employers alike.”

White House to clarify foreign investor and temporary worker rules

U.S. Citizenship and Immigration Services officials recently announced that they are beginning an effort to clarify regulations for foreign investors seeking a temporary worker visa like the H-1B visa.

Also included in the effort will be information on the EB-5 green card visas available to foreign investors looking to start a business in the United States.  While up to 10,000 EB-5 visas can be given out a year, only about half as many are typically used.

Federal officials say they will hold forums that will provide information on obtaining the H-1B visa and the EB-5 green card visa and will work with employers to further inform them on temporary worker visas.

Gov. Brown signs DREAM Act

Last week, California Governor Jerry Brown signed the DREAM Act into law in Los Angeles.  The state law is similar to, but separate from, the federal version of the DREAM Act.

The new law allows children of illegal immigrants to become citizens of the United States through higher education or service in the military.

The law was built off of California’s previous law that enabled children of illegal immigrants to obtain in-state tuition at state schools if they attended high school in California for at least three years.  However, the original version of the law did not specify anything about immigration status.

The DREAM Act will go into effect on January 1, 2012.
