Who Is The Bankruptcy Trustee And What Is His/Her Role?

During the bankruptcy process, the courts will typically appoint a person to take on the role of the bankruptcy trustee, who has a very important job. This person’s sole responsibility is to analyze the actual bankruptcy filing, arrange and conduct the meeting of all the creditors, determine whether the debtor may be eligible for a discharge, sell or liquidate any of the debtor’s non-exempt assets, and then allocate the proceeds collected from the liquidation/sale to the creditors under a disbursement plan set forth in the Bankruptcy Code.
