I Received Something Called “Notice Of Commencement Of Case”; What Is This?

Typically, once you file for bankruptcy, within about a two week period, you will receive documents entitled “Notice of Commencement of Case”. The purpose of this document is to provide the debtor with pertinent information regarding his / her bankruptcy filing. For instance, it will typically include the following information:

  • The case number;
  • A description of the automatic stay;
  • The date that has been scheduled for a meeting with all of the debtors creditors;
  • A deadline date for any objections by creditors to allowing dischargeability of debts or the debtor (creditors usually have 90 days from the date the bankruptcy was filed to make such objections);
  • The name and contact information of the debtor ’s attorney;
  • The name and contact information of the bankruptcy trustee; and
  • A notice to creditors advising whether they should file claims with the court and in the event that the creditor does make a claim with the court, the deadline for such claims.
