TN Nonimmigrant Visas
The United States, Canada, and Mexico have a special agreement called NAFTA that encourages free trade and commerce between these three countries. NAFTA, or the North American Free Trade Agreement, also allows Canadian and Mexican citizens to travel to the United States for nonimmigrant employment positions.
Although these NAFTA members do not require a full nonimmigrant employment visa, they still must meet certain qualifications in order to come to the U.S. For help with applying for your visa to the U.S., please contact an experienced Orange County immigration attorney from Garg & Associates, P.C., today at 949-540-6704.
What is a TN Visa?
Many Canadian and Mexican citizens can apply for a TN visa rather than an H-1 or other temporary business visa. A TN visa allows citizens from NAFTA countries to come to the United States for specific business purposes. This can allow individuals to stay for up to three years, with the option of filing for an extension. You can also file for TD visas for your spouse and qualifying children.
Requirements for a TN Visa
There are several different requirements an applicant must meet in order to apply for a TN visa, including:
- Proof of Canadian or Mexican citizenship
- Proof of full-time or part-time employment opportunity
- Occupation is on the NAFTA list
- The applicant is qualified to fulfill the position
Additionally, access to a position can depend on whether or not the U.S. needs employees in that specific area. If not, you may have to apply for a regular visa.
