Military Family Members Immigration Rules
The United States puts a great deal of faith in those who elect to serve in the armed forces, both at home and abroad, and offers certain special dispensations for the immigration processes of servicemen and their families. One year of service in the U.S. Armed Forces grants anyone the immediate right to apply for citizenship, and any active duty whatsoever bestows the same privilege.
What is less well known is that the naturalization process for the families of U.S. military members may also receive special privileges in the process of becoming a citizen. These rules apply to the family of anyone who has served active or reserve duty with any of the branches of the U.S. Armed Forces including the Marines, Army, Navy, Air Force, and Coast Guard.
Special Rules and Exceptions
In honor of the service they have provided to the country, the families of U.S. military members enjoy the following privileges when applying for citizenship:
- Overseas postings count towards U.S. residency. When accompanying their spouse overseas under military orders, you may count your time abroad as if it were spent in the U.S., aiding in U.S. residency requirements for citizenship.
- Posthumous citizenship may be awarded to non-citizen military personnel who are killed in action. Family members may apply for citizenship for the deceased, which will be awarded as of the date of the person’s death.
- Family members of U.S. citizen military members killed in action may immediately apply for citizenship. If you are already a permanent resident, you may immediately apply for citizenship if your U.S. citizen spouse, child, or parent is killed in action.
The United States honors those with the courage to serve their country, and their family members are encouraged to continue the process of naturalization.
