Marriage and Permanent Residence
The United States government allows for U.S. permanent residents to bring over spouses and children. However, to protect against fraud, the U.S. Citizenship and Immigration Services, or USCIS, makes permanent residence status conditional if it is based on a marriage that is less than two years old. Therefore, people must prove that they did not get married solely to immigrate to the United States.
After you have been married for over two years after you have been lawfully admitted to the U.S., you have to file special paperwork in order to remove the conditional sanction on your permanent residency. Eligibility to Remove Restrictions
Your permanent residency restrictions are not automatically removed once you reach two years of marriage. In fact, you must apply to have the restriction lifted. This is also true if your marriage ends due to death of your spouse, annulment, etc. The form that you must file is the form I-751, and you must also meet one of the following eligibility requirements:
- You must still be married to the same U.S. permanent resident or citizen after 2 years
- You are widowed from a marriage to a U.S. citizen or permanent resident that was entered in good faith
- You are divorced or had an annulment of a marriage that was made in good faith
- You were married in good faith, but then suffered from battering or hardship from your spouse
- The termination of your permanent residency would place you in an extremely difficult situation
