Foreign Ministers in the United States
Every year, thousands of religious workers come to America to practice and preach their beliefs. America welcomes many of these individuals by way of an R-1 visa. Ministers coming to America must meet a variety of eligibility requirements to be considered.

Eligibility Requirements for an R-1 Visa
In order for a minister or other religious leaders to be granted an R-1 Visa, they must meet the following requirements:
- Minister works in a religious occupation related to a traditional religious function
- The individual works as a minister for their occupation
- The sponsoring organization is a nonprofit religious organization exempt from taxation under section 501 (c)(3)
- Minister can prove they have been a part of a nonprofit religious organization for at least two years
How We Can Help
In order to receive R-1 classification outside the United States, a person must visit the U.S. Consulate in their country. If in the United States, a person may be eligible to switch to an R-1 visa by filing with the USCIS. The paperwork for these procedures is complicated and a claim may be easily denied if all aspects are not covered.
The Consulate and USCIS examine this paperwork carefully before a visa can be granted, and these visas have become more difficult to obtain in recent years. This is yet another reason why it is strongly advisable to seek the guidance and representation of a knowledgeable attorney.
