Applying for a Visa Extension in the U.S.
Nonimmigrant visas are short-term visas that are granted to foreign workers and visitors who are temporarily staying in the U.S. Whether you are a tourist, a worker seeking to move to the United States, or a foreign student, it is important to have the proper visa to gain entry to the United States. When your visa expires, you are required to leave the country or risk being penalized and deported. It may be possible for you to apply for a new visa in order to extend your stay in the United States.
Renewing Your Visa
If your visa is expiring soon and you want to remain in the U.S., consider renewing your visa as soon as possible. The requirements for requesting an extension or re-applying for a new visa vary depending on your current visa status. If you have a current valid visa and want to request an extension on the same visa, you can complete the renewal application without leaving the country. Follow these steps to apply for a visa extension:
- Complete form I-539 Extension of Stay / Change of Status, which can be downloaded from the USCIS website
- Include all materials listed on the application, a letter explaining your reason for requesting an extension, and a check or money order for the full application fee amount
- Mail your complete application packet to the nearest USCIS office
Once the USCIS has received your materials, you will be mailed a receipt of its acceptance. It could take up to 6 weeks for the USCIS to process your application. Your receipt gives you the legal right to remain in the country while your visa extension is being processed, so it is important to keep this document with you at all times.
